These General Terms and Conditions ("Terms") govern the relationship between Higher Stays v.o.f., located at Swolgensedijk 9e, 5962NP, Melderslo, Netherlands, and property owners using our services. By using our services, you agree to these Terms.

1. Definitions

  • Higher Stays v.o.f.: The company providing short-term rental management services.

  • Property Owner (Client): The individual or entity that owns a property and contracts Higher Stays for rental management.

  • Guest: A person renting the Client's property through a third-party booking platform.

  • Third-Party Booking Platforms: External websites such as Airbnb, Booking.com, and Vrbo where properties are listed.

2. Scope of Services

Higher Stays provides the following services to property owners in Europe, with a focus on Italy, Spain, Portugal, and Greece:
✔️ Listing and managing properties on third-party booking platforms.
✔️ Guest communication and customer support.
✔️ Cleaning and maintenance coordination.
✔️ Check-in and check-out management.
✔️ Handling guest complaints.

3. Agreement and Duration

  • Clients enter into a contract with Higher Stays without a minimum service period.

  • Either party may terminate the contract with a one-month notice period.

  • If the Client terminates the contract early, a fee based on expected income will be charged.

  • Higher Stays reserves the right to terminate the agreement in case of a contract breach.

4. Fees and Payment

  • Higher Stays works on a commission-based model only.

  • The commission rate starts at 18% and goes up to 25%, depending on the property location and service level.

  • Clients receive payments once Higher Stays is paid by the third-party booking platform (typically once per month).

  • Payments will be made via bank transfer or PayPal.

  • No additional fees are charged beyond the commission.

5. Responsibilities and Liability

5.1 Higher Stays' Responsibilities

  1. Higher Stays is responsible for handling guest complaints related to service issues (e.g., check-in delays).

  2. If a complaint arises due to property maintenance issues (e.g., leaks, broken appliances), it is the Client’s responsibility.

  3. Higher Stays will assist in handling damage claims with booking platforms but is not financially responsible for any damages.

  4. Higher Stays does not require Clients to have insurance, but Clients remain liable for all damages occurring during the rental period.

5.2 Client's Responsibilities

  1. The Client must ensure that the property meets all safety, legal, and regulatory requirements.

  2. The Client is responsible for property maintenance, including repairs and essential amenities.

  3. The Client must comply with local rental laws and is responsible for any associated permits, taxes, or fines.

6. Guest Relations

  • Higher Stays manages guest communication, check-ins, and check-outs.

  • House rules, check-in times, and other conditions will be customized per property and clearly communicated to guests.

  • The Client cannot interfere with guest relations unless otherwise agreed upon.

7. Data Protection

  • Higher Stays only collects necessary data for contract execution and service improvement.

  • No personal data is used for marketing purposes unless explicitly agreed upon.

  • Clients can request access to their stored data or deletion by contacting info@higherstays.com.

8. Termination and Dispute Resolution

  • Termination Notice: Either party may terminate the agreement with a one-month notice.

  • If the Client terminates early, a fee based on projected earnings will apply.

  • Any disputes will first be resolved amicably. If no resolution is reached, disputes shall be settled in a Dutch court under Dutch law.

9. Changes to These Terms

  • Higher Stays may update these Terms when necessary.

  • Changes will be communicated via email notification.

  • Continued use of the services after an update constitutes acceptance of the new Terms.

10. Final Provisions

  • These Terms and Conditions are governed by Dutch law.

  • If any provision is found to be invalid or unenforceable, the remaining provisions remain in effect.

  • Failure to enforce any part of these Terms does not waive our rights.
